General Terms & Conditions

Christoph Bacher Archäologie Ancient Art GmbH is a gallery for ancient art objects in Vienna. The gallery offers acquisitions and sale of ancient works of art, provides estimates and expertise of ancient art works and advice and assistance in establishing a private collection of ancient art. In addition, upon request, it also carries out research in the relevant literature areas.

Gallery:
Christoph Bacher Archäologie Ancient Art GmbH

Client:
The buyer, who purchases objects or items from Christoph Bacher Archäologie Ancient Art GmbH – either in his own name for the account of a third party, or in his own name for his own account.

Gallery Sale:
Christoph Bacher Archäologie Ancient Art GmbH maintains at the address 1010 Vienna, Stubenring 20, a premise where items are offered for the immediate sale. At the address 1030 Vienna, Untere Viaduktgasse 55, the gallery maintains a showroom with 160 square meters for additional ancient art exhibitions. The showroom is only open by appointment.

Selling Price:
The selling price is the price as agreed in the context of the gallery sale. This is understood as, excluding applicable transportation and insurance fees, including applicable taxes and charges to be borne by the client according to the fee and charges regulations. Currently the value added tax in Austria is 13 percent.

Shipment:
Shipment of an item is always carried out by a professional art transportation company at the expenses of the client. Upon request shipment can be provided by a courier service (Fedex, UPS, DHL etc.). For our international clients we can offer shipment with DHL worldwide with special rates. The insurance value is all cases limited to a maximum of 15 000 Euro. Higher insurance values have to be requested by the client.

Reservation of Property Rights:
Until such time as full payment is received, the item remains entirely the property of the gallery Christoph Bacher Archäologie Ancient Art GmbH.

Ancient Art Works:
All works of art are sold as described. The authenticity of the ancient objects is guaranteed without any limitations. We put great importance on the impeccable provenance of the objects. International customers receive the law corresponding to each acquired object an official export authorization of the Austrian “Bundesdenkmalamt”.

Offer:
Our offer is insofar non-binding, as slight color deviations compared to our images or descriptions are possible due to technical reasons. The seller guarantees for the correctness of the descriptions.

Right of withdrawal:
Clients from the EU have the right to withdraw from this contract within fourteen days without providing any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you take possession of the last item. To exercise your right of withdrawal, you must notify us, Christoph Bacher Archäologie Ancient Art GmbH, Stubenring 20, 1010 Vienna. Tel.: +43 664 1168 324, Email: info@cb-gallery.com, of your decision to withdraw from this contract by means of an unambiguous declaration (e.g., a letter sent by post or email with a read receipt). If you exercise this option, we will immediately send you a confirmation of receipt of such a withdrawal (e.g., by email). To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of withdrawal:
If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the date on which we received notification of your withdrawal of this contract. For this refund, we will use the same method of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back in the same condition as sold. You must return or hand over the goods to us (see above address) promptly and in any event no later than fourteen days from the date on which you notify us of the withdrawal of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

Language:
If there is any conflict in meaning or interpretation between the English and German text on this website, the German text shall govern.

Data Storage:
In accordance to paragraph 28 of the Federal Data Protection Act we point out that within the business process data are processed and stored by a computer system in accordance of paragraph 33 of the Federal Data Protection Act. Obviously, personal information is treated with confidentiality. The customer agrees until further notice to the seller the usage of his address for sending newsletters and information in his own interest per email and/or postal service. These data and personal information are under no circumstances shared with third parties.

Newsletter:
Christoph Bacher Archäologie Ancient Art GmbH sends out per email one, a maximum two times per month, a newsletter reporting about current activities, exhibitions, participation at art fairs and acquisitions of the gallery. The newsletter is exclusively sent to recipients who have prior given their consent in written or oral form. The customer has the possibility with every mailing to reject free of charge and without any problems the receipt thereof, and to permanently unsubscribe to any further receipt. In this case all data of the customer will permanently be deleted. Herewith the gallery complies to all obligations of the EU General Data Protection Regulation ( EU-GDPR) which enters into force on 25 May 2018.

Place of Jurisdiction:
Place of performance and jurisdiction for both parties are the Handelsgericht Wien, Österreich. Exclusively Austrian law applies.
